The Park District for the City of Minot (The “Minot Park District” or “MPD”) has built the Minot Park District Parks and Trails mobile application (the “App”) as a free app.  This App is provided by MPD at no cost and is intended for use as is.  

This page is used to inform App users regarding our policies with the collection, use, and disclosure of Personal Information for anyone who decides to use our App and the service it provides.

If you choose to use our App, then you agree to the collection and use of Personal Information in relation with this policy.  The Personal Information that we collect will be used for providing and improving the Service.  We will not use or share your information with anyone except as described in this Privacy Policy.

Information Collection

We may collect information about you in a variety of ways.  The information we may collect on the App includes:

GeoLocation Information.  We may request permission to access your device’s location while you are using our mobile application to provide location-based services.  If you wish to change our access or permissions, you may do so in your device’s settings.

Mobile Device Data.  We may collect device information (such as your mobile device ID, model, and manufacturer), operating system, version information, and IP address.

Analytics.  We also partner with Google Analytics to include tracking technologies in the App to analyze and track users’ use of the App, determine the popularity of certain content and better understand activity.  By assessing the App, you consent to the collection and use of your information by Google Analytics.  You are encouraged to review Google’s privacy policy and contact them directly for responses to your questions. 

Cookies.  Cookies are files with a small amount of data that is commonly used as an anonymous unique identified.  These are sent to your browser from the website that you visit and are stored on your device’s internal memory.  This App does not use these “cookies” explicitly.  However, the App may use third party code and libraries that use “cookies” to collection information and to improve their services.  You have the option to either accept or refuse these cookies, and know when a cookie is being sent to your device.  If you choose to refuse our cookies, you may not be able to use some portions of this App.

You should be aware that getting a new mobile device may also clear certain opt-out cookies, plugins, or settings.

Support for Do Not Track Features

Most web browsers and some mobile operating systems and our mobile applications include a Do Not Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected.  No uniform technology standard for recognizing and implementing DNT signals has been finalized.  As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.  If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy policy.

Use of Information

Having accurate information about your location and usage of the App permits us to provide you with a smooth, efficient, and customized experience.  Specifically, we may use information collected about you via the App to:
  • Assist law enforcement and respond to subpoenas.
  • Compile anonymous statistical data and analysis for use internally or with third parties.

  • Increase the efficiency and operation of the App.

  • Monitor and analyze usage and trends to improve your experience with the App.

Third Party Services

MapBox.  The App uses MapBox APIs to provide maps and location.

Carrier Charges

MPD does not charge for the Application, but your carrier’s data rates may apply to your use of the Application.

Security of Data Transmission and Storage

Electronic communications using the Application may not always be encrypted.  You acknowledge that there is a risk that data, including email, location information, electronic communications, and personal information, may be accessed by unauthorized third parties when using the App.

MPD or its affiliates or agents may monitor your use of the App to evaluate the quality of service you receive, the security of the Application, or for other reasons.  You agree that such monitoring activities will not entitle you to any cause of action or other right with respect to the manner in which MPD or its affiliates or agents monitor your use of the App.  In no event will MPD or any of its affiliates or agents be liable for any costs, damages, expenses, or any other liabilities incurred by you as a result of monitoring activities or the loss of personal information by MPD or its affiliates or agents.

Hyperlinks

The Application may contain links to other sites.  MPD does not control such other sites, and MPD and its affiliates and agents make no representations whatsoever concerning the content, accuracy, security or privacy of those sites. The fact that MPD has provided a link to a site is not an endorsement, authorization, sponsorship, or affiliation with respect to such site, its owners or its providers.  There are risks in using any information, software, or products found on the Internet, and MPD cautions you to make sure you understand these risks before retrieving, using, relying upon, or purchasing anything via the Internet.  You agree that under no circumstances will you hold MPD or its affiliates or agents liable for any loss or damage caused by use of or reliance on any content, goods, or services available on other sites.

Governing Law

The Privacy Policy, and use of the App shall be governed by the law of the State of North Dakota, without regard to conflicts of law principles thereof.  This is the case regardless of whether you reside or transact business with MPD or any of its affiliates or agents in the State of North Dakota or elsewhere.  You agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Ward, State of North Dakota. If any part of this policy is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions.

Miscellaneous

This policy constitutes the entire understanding and agreement between you and MPD regarding the App, and governs your use of the App.  If any provision of this policy shall be held invalid under law, such invalidity shall not affect any other provision or provisions hereof which are otherwise valid.  The failure of MPD to enforce any provision in this policy shall not constitute a waiver of such provision or any other provision.
